Privacy Notice – Sportsdata Data Journalist Application

1. Introduction

1.1. Sportsdata AG respects your privacy and personal data. This Privacy Notice (hereinafter referred to as “Notice”) explains how we process your personal data collected when you apply for the position of Data Journalist as well as your personal data collected during any further activities related to the position of Data Journalist. Personal data means any information which allows Sportsdata AG and/or the Sportradar Group to directly or indirectly identify you.

1.2. This Notice applies where Sportsdata AG acts as a controller of the personal data being collected and processed from our Website. This means that this Notice applies where Sportsdata AG determines the purposes and means of the processing of the personal data.

1.3. Your personal data will be processed in accordance with the EU General Data Protection Regulation (hereinafter referred to as the “GDPR”) and with any other applicable privacy and data protection laws.

1.4. The Sportsdata AG Website may contain links to websites of third-parties which are not covered by this Notice. Sportsdata AG does not accept any responsibilities or liabilities for third-party websites.

1.5. We strongly encourage you to take some time to read this Notice in full. If you do not agree to this Notice, we kindly request you not to provide us with your personal data. Declining to provide Sportsdata AG with the required personal data for the position of Data Journalist may result in the altogether halting of the application process or in the termination of your activities as a Data Journalist.

2. Who is Sportsdata AG?

Sportsdata AG is a brand of Sportradar, a global leader in understanding and leveraging the power of sports data and digital content for its clients around the world. Sportsdata AG is a market leader for live sports coverage, providing the most comprehensive, reliable and fastest live data service for a broad range of sports.

2.1. When this Notice mentions “we,” “us,” or the “Company,” it refers to the controller of your data under this Notice, namely Sportsdata AG (VAT identification number CHE-113.075.404, Feldlistrasse 2, CH-9000 St. Gallen, Switzerland) with which you had, have or will have a business relationship or that otherwise decides which of your data are collected and how they are used.

2.2. You may obtain a list of the Sportradar Group affiliates by contacting the Sportradar privacy office, which can be found below in Section 11 of this Notice.

3. What Personal Data Do We Collect?

3.1. You can find below the categories of personal data processed by Sportsdata AG. We process personal data which is provided by you and personal data which is automatically collected by us.

3.2. Personal Data Provided to Us by You During The Application Process

During the application process for the Data Journalist position, we may collect the following categories of personal data:

  • Your username
  • Your password
  • Your first name and last name
  • Your address
  • Your phone number
  • Your e-mail address
  • Your Skype username
  • Your date of birth
  • Your nationality
  • Your default time zone.

3.3. Personal Data Provided to Us By You After The Application Process

After your application for the position of Data Journalist, we may also collect the following categories of personal data:

  • Your national identification number with a photo of you (ID card, passport or driver’s license)
  • Your letter of intent containing your personal signature
  • A picture of you
  • Screenshots containing your face taken during Skype tutorials
  • Your payment information (bank account number, Skrill or PayPal e-mail address)
  • Audio recordings from devices provided to you.

3.4. Personal Data Automatically Collected By Us After The Application Process

After your application for the position of Data Journalist, we may also collect the following categories of personal data:

  • Your IP address
  • Your browser ID
  • Your log-in and log-out time stamps
  • Changes you have made on the database
  • Your availabilities
  • Details of the pages you have visited on the Sportsdata AG portal for Data Journalists.

3.5. When providing us with your personal data, Sportsdata AG kindly requests you to refrain from supplying us with any additional unsolicited personal data. In particular, Sportsdata AG requests you to refrain from supplying us with personal data relating to:

  • Your racial and ethnic origin, and/or;
  • Your political opinions, and/or;
  • Your religious and philosophical beliefs, and/or;
  • Your trade union membership, and/or;
  • Data concerning your health, and/or;
  • Data concerning your sex life or sexual orientation.

4. How Do We Process Your Data?

4.1. For What Purposes Do We Process Your Personal Data?

  • For the execution, fulfillment, handling and administration of the activities related to the Data Journalist position
  • For fraud prevention and integrity reasons.

4.2. Profiling

We may carry out profiling on your personal data for fraud prevention and integrity reasons. The profiling may produce consequences which may adversely affect your application or your activities as a Data Journalist.

Sportsdata AG reserves the right to halt the application process as well as to suspend and/or terminate your account should the profiling that has been carried out on your personal data indicate illegitimate, fraudulent or suspicious activity.

4.3. On What Legal Grounds Do We Process Your Data?

In order to process your personal data, we may rely on different legal grounds, including:

  • Your consent, insofar as it is legally required or permitted. If we rely on your consent as a legal basis for processing your personal data, you may withdraw your consent at any time. This right is further specified in Section 9.9 of this Notice.
  • The necessity to establish a contractual relationship with you and to perform our obligations under the concerned contract.
  • The necessity for us to comply with legal obligations to establish, exercise, or defend ourselves from legal claims.
  • The necessity to pursue our legitimate interests, including, but not limited to:
    • Fraud prevention and integrity maintenance
    • To administer and generally conduct business within the Company.

5. Do We Collect Data From Children?

5.1. Sportsdata AG does not knowingly collect personal data from children. The definition of “children” is subject to local and national laws and may vary accordingly.

6. When Do We Transfer Your Personal Data?

6.1. Sportsdata AG may make your personal data available to affiliated companies or subsidiaries of the Company, as well as to its subcontractors or other trusted third parties if applicable. Passing on your personal data to rights holders like leagues, federations or clubs may be necessary in order to receive accreditations, media passes and similar access rights that may be needed to perform the task of being a Data Journalist for Sportsdata AG. The same applies for Integrity Units of national governments or federations to detect possible fraud or illegal activity of the Data Journalists.

6.2. When transferring your personal data to a third-party located outside of the European Union or in countries which do not provide the same standard of personal data protection, we have put in place adequate measures to protect your data, such as organizational and legal measures (including the EU Model Contract Clauses) to ensure the protection of the personal data. You may obtain a copy of these measures by contacting the Sportradar Privacy Office, which can be found below in Section 11 of this Notice.

6.3. Using the mobile application "iScout" does result in automatically using Fabric as the performance tool for monitoring. Sportsdata AG is using Crashlytics and Audience tools from Fabric. Those tools will receive the username of the Data Journalist for referencing technical issues. In addition, those tools will collect device state information, unique device identifiers, device hardware and OS information, information relating to how an application functions, and the physical location of a device at the time of a crash.

7. How Do We Secure Your Data?

7.1. Sportsdata AG uses all available technical and organizational security measures in order to protect your personal data against a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, your personal data transmitted, stored or otherwise processed.

7.2. Sportsdata AG employees are required to keep personal data confidential. Sportsdata AG employees will only transfer your personal data to third parties as described in Section 6 of this Notice.

8. How Long Is My Data Kept?

8.1. Sportsdata AG does not keep personal data for longer than it is necessary for the purposes set out in Section 4 of this Notice.

8.2. Depending on the category of personal data, we are unable to establish in advance the applicable retention period. We will determine the appropriate retention schedule with basis on the following criteria:

  • For the sake of fraud prevention we may keep this data for a period of time that cannot be established in advance. However, we regularly review (at the latest every 5 years) the data that we store about you to ensure this is still necessary to meet the purposes explained above in Section 4 of this notice.

9. What Are My Rights?

9.1. Sportsdata AG reserves the right to refuse to give effect to a petitioner’s request in the event that Sportsdata AG is unable to ascertain your identity.

9.2. Right to Access

You have the right to obtain from Sportsdata AG a confirmation of whether Sportsdata AG is processing your data. Should Sportsdata AG process your data, you have the right to access your personal data and to obtain further information regarding the processing of your personal data.

9.3. Right to Rectification

You have the right to have your personal data rectified by Sportsdata AG in the event that your personal data is inaccurate. You may also rectify the information by reviewing and changing the personal information on your account settings.

9.4. Right to Erasure

Under certain conditions, you have the right to have your personal data erased without delay. Those conditions are listed in Article 17 of the GDPR.

9.5. Right to Restriction of Processing

Under certain conditions, you have the right to restrict the processing of your personal data. Those conditions are listed in Article 18 of the GDPR.

9.6. Right to Object to Processing

Under certain conditions, you have the right to object to the processing of your personal data by Sportsdata AG. Those conditions are listed in Article 21 of the GDPR.

9.7. Right to Data Portability

You have the right to obtain your personal data in a structured, commonly used machine-readable format and to have your personal data transferred to another controller upon your request, and where technically feasible insofar as the processing of your personal data relies on your consent or it is necessary for the performance of a contract between you and Sportsdata AG.

9.8. Right to Complain To a Supervisory Authority

Should you believe that Sportsdata AG has infringed the applicable data protection laws, you have the right to file a complaint before the concerned Data Protection Authority.

9.9. Right to Withdraw Consent

You may withdraw your consent to the processing of your personal data insofar as the processing relies on your consent. This does not apply if the processing is required for the performance of a contract between Sportsdata AG and you or if the processing is based on Sportsdata AG legitimate interests.

10. Policy Changes

Sportsdata AG reserves the right, at its discretion, to update, change, modify, add or amend this Policy by publishing a new version on our Website.
